Contract terms

1 Master contract and file acceptance

This Contract governs every current and future bail-fugitive recovery file Client sends to Investigator after the Effective Date. A file becomes an Assigned File only when Investigator confirms acceptance in writing or begins work. Email, text message, case-management entry, or delivery of the file may document an assignment. A separate contract is not required for each file. Written terms accepted for a particular file control only that file.

2 Services authority and documents

For each Assigned File, Client retains Investigator to investigate, locate, and, when lawful and authorized, apprehend or surrender the Defendant, and to document facts that may support exoneration or tolling. Client represents that it has authority over each bond and shall promptly provide the bond, valid arrest authorization, photograph, bail and indemnitor applications, court notices, deadlines, and all available information. Investigator does not provide legal advice or guarantee apprehension, tolling, exoneration, or a court ruling.

3 Fees

The fee is based on the penal amount of each Assigned File and the number of calendar days after forfeiture when Investigator receives a complete file: 0–45 days: 8% or $1,500, whichever is greater; 46–180 days: 10% or $2,000, whichever is greater; 181–240 days: 15% or $2,500, whichever is greater; and over 240 days: 20% or $3,000, whichever is greater, plus a nonrefundable $500 rush fee due upon acceptance. Each bond is charged separately unless agreed otherwise in writing.

4 Successful result and payment

The full agreed fee is earned upon the first Successful Result: the Defendant is apprehended, surrendered, arrested, or located in custody by Investigator, Client, law enforcement, another agent, or any third party; death is verified; Investigator’s information, surveillance, report, notification, or coordination materially contributes to an arrest, surrender, custody confirmation, exoneration, or tolling; or the court grants exoneration, tolling, or other relief based in whole or in part on facts Investigator discovered or documented. Payment is due within 72 hours after the Successful Result. Client’s use or disclosure of Investigator’s information does not defeat the fee.

5 Reports expenses and cooperation

A declaration or investigative report prepared for court is $350, paid before delivery. Extraordinary travel, transport, lodging, or additional-personnel expenses require Client approval. Client shall disclose prior or current investigators and immediately report contact with, arrest of, surrender by, or court action involving a Defendant. Any different rate caused by prior work must be agreed to in writing.

6 Term and termination

This Contract continues until either party terminates it in writing. Termination stops new assignments but does not cancel an existing Assigned File unless stated in writing. Earned fees and approved expenses remain due. If a Successful Result occurs during an assignment or within 180 days after its termination and arises from Investigator’s work or information, the agreed fee remains due.

7 Operations and general terms

Investigator is an independent contractor and controls investigative and field methods. Investigator may delay or stop unsafe or unlawful activity, activity lacking proper authority, or activity likely to interfere with law enforcement. Client accepts reasonable medical expenses incurred by a Defendant as a direct result of a lawful apprehension, except to the extent caused by Investigator’s gross negligence, willful misconduct, or unlawful conduct. California law governs. This is the complete contract and may be changed only in a writing signed by both parties. Electronic and counterpart signatures are valid. If a provision is unenforceable, the remainder stays effective. The prevailing party in an enforcement action may recover reasonable attorney fees and costs to the extent allowed by law.

By signing, Client authorizes Investigator to proceed only with the written scope above and acknowledges receiving a copy of this Contract. No assignment is accepted until the Investigator completes any required countersignature or confirms acceptance in writing.
